Well, to be clear, you can call it what you want (tariff, duty, etc), but Trump has shown that there are mechanisms capable of putting pressure on other countries (even if short term). So, the "threat" (which would, indeed, be very likely overturned) is real.

Other countries know that it will ultimately fail, but that doesn't help in the 6 months before a court can rule on whatever "alternative version" of the policy is enacted this round. Something that doesn't fall under the prior ruling but will be struck down just the same.
