The number should be changed to all companies to say "95% of investors do not make money". It is a more accurate statement but my low level understanding is that the number and how its presented is a regulatory requirement.

this is always the case. To get trades you can actually send to the market in some way the type of trading must change. For example, opening 30 lots every click on 200k is not going to ever be a-book.
